It is likely but no decision has been rendered. It appears to fall within the definition of an "automobile" given it is self-propelled.
Section 3(1) of the Off-Road Vehicle Act requires that
a dirt bike be registered given it falls within the definition of
off-road vehicle, but does not specifically require that it be
covered by a motor vehicle liability policy before it is
driven.
Whether the Automobile Part of the Insurance Act would
apply would depend on (i) whether registered under the Motor
Vehicle Act; or (ii) whether insured under a policy approved by the
Superintendent.
